Being fully informed of the scope of activities in which I will participate and to which I may or will be exposed, I consent to participation in musical and community activities (the “Activities”) through Moon & Stars Foundation DBA Kutandara (“Kutandara”) and participation in certain optional activities and performances (“Field Trips”) in which I wish to participate.

In connection with the Field Trips and Activities, I may be exposed to hazardous conditions, such as changing weather conditions, disease, inadvertent contact with animals, contact with other adults and children, varied travel conditions, bodies of water, undetermined physical performance venues, insects, food (i.e., unforeseen peanut residue left on a picnic table or swing at parks), and other hazards.

I may also participate in certain activities, such as the set up and break down of musical instruments and stage platforms, which will involve uncertain location conditions and varied physical terrain. These are some, but not all, of the risks inherent in the Activities and Field Trips; a complete listing of inherent and other risks is not possible.

There are also risks that cannot be anticipated. Many, but not all of these risks are inherent in these and other activities. Equipment used in the activity may break, fail, or malfunction, despite reasonable maintenance and use. Some of the equipment used in activities may inflict injuries even when used as intended. Persons using equipment may lose control of such equipment and cause injury to themselves and to others. Kutandara’a employees, agents, and representatives will use their best judgment in determining how to react to circumstances; however they may misjudge such circumstances, an individual’s capabilities, and other factors.

I have had the opportunity to ask questions of Kutandara regarding the Activities and Field Trips and I wish to participate in the Activities and Field Trips. In consideration of Kutandara permitting me to engage in the Activities and Field Trips, I hereby release and forever discharge Kutandara, and its employees, agents, and representatives (collectively, the “School”) from all claims, actions, and/or liabilities based on or arising from injury, loss, damage or death to me, or injury, loss or damage to any property owned by me, which is caused by or sustained in connection with my participation in the Activities and Field Trips including negligence in training, maintenance, care, supervision, conditions to which I am exposed and/or supervision of the other participants.

I agree to abide by and follow any instructions given or rules established by the School regarding the Activities and/or Field Trips. I shall indemnify the School for the defense of any such claims and/or actions (including reasonable attorneys’ fees and costs), and for any liabilities based on or arising from such claims and/or actions.

I have read and understand the above and agree to be bound by the terms of this document, and understand that payment of fees to Kutandara constitutes my legal agreement to the above.

Acknowledgment & Assumption of Risks and Waiver of Claims for Minors

Being the parent and/or legal guardian of a minor (“Student”) in consideration of and as outlined above, give my permission for my child to participate in all Activities and Field Trips, including those described above.

I acknowledge and assume the risks involved in these activities, and for any damages, illness, injury or death resulting from such risks for myself and my child. I, on behalf of myself and my child, hereby release and waive any claim of liability against the School with respect to any injury occurring to my child while he/she participates in any and all Kutandara Field Trips and the Activities, and any hazardous conditions related thereto, to the full extent allowed by Colorado law including CRS § 13-22-107.

I hereby agree to indemnify and hold harmless the School with respect to any claim asserted by or on behalf of my child as a result of injury.

I have read and understand the above and agree to be bound by the terms of this document, and understand that payment of fees to Kutandara constitutes my legal agreement to the above.
